You can remove a bird's nest from a chimney once it is no longer in use: when the young have fledged and the adults have stopped visiting. While a wild bird is building a nest or has eggs or chicks in it, the nest is protected under the Wildlife and Countryside Act, so the flue cannot simply be cleared. In practice that usually means waiting until late summer, then having the chimney swept, checked and fitted with a guard before the birds return.

How to tell whether the nest is active
Signs of an active nest include birds carrying twigs to the pot, adults coming and going regularly, and cheeping from the flue. Silence for a couple of weeks after that busy period normally means the brood has left. If you are unsure, a sweep can look from the top of the stack or use a camera from below without disturbing it.

What to do while you wait
Do not light the fire or stove on that flue. A nest can block it completely, sending fumes back into the room, and dry nest material can catch light. Close off the fireplace opening if soot or debris is falling, and keep a working carbon monoxide alarm in the room. If the flue serves your only heating, talk to us about the options rather than taking a risk.
Where a nest poses a genuine and immediate danger, speak to a professional before doing anything; the protection is there for the birds, but safety matters too, and there are proper routes for handling it.
Clearing the flue once it is empty
Chimney nests can be very large, packed down over several seasons. Removal usually means working from the fireplace with rods and specialist heads, collecting the material as it falls, then sweeping the flue properly. A camera survey afterwards confirms nothing is still lodged on a ledge or bend. You are issued a sweeping certificate once the flue is clear.
Stopping it happening again
The permanent fix is a bird guard or suitable cowl on the pot, fitted outside the nesting season so no birds are trapped. On a flue that is no longer used, capping it with ventilation is another option. The right choice depends on whether the chimney serves an appliance, what fuel it burns and the style of the pot.
Why nests keep coming back to the same flue
Birds that nest in chimneys tend to return to a site that worked for them before, and an old nest left in place gives next year's pair a head start. Even after clearing, a few sticks lodged on a ledge can be enough to invite a new attempt. That is why the job is not finished when the nest comes out: the flue should be swept through, checked for leftovers and closed to birds at the top. Leaving the pot open after a clean usually means repeating the whole process within a year or two.
If you rent out the property, record when the nest was cleared and when the guard was fitted alongside your sweeping certificate. It shows tenants and insurers that the problem was dealt with properly rather than left until it became dangerous.
